These Terms of Service ("Terms") govern your access to and use of Bessie, a done-for-you digital business platform provided by [Legal Business Name] ("Company," "we," "us," or "our"), including our website at meetbessie.com and any related dashboard, communications, and services (collectively, the "Service").
By creating an account, subscribing to Bessie, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Bessie handles day-to-day business tasks on your behalf, including but not limited to appointment bookings, payment collection, customer follow-up, messaging, reputation and review management, and reporting. Bessie is built on third-party technology infrastructure and is provided to you as a hosted service — you do not receive a copy of any underlying software, and you have no rights to it beyond your use of the Service as described in these Terms.
Not a licensed professional. Bessie is a business automation tool. It does not provide legal, financial, medical, or other licensed professional advice, and nothing Bessie sends on your behalf should be treated as such.
You must be at least 18 years old and able to form a binding contract to use Bessie. When you create an account, you agree to:
You are responsible for ensuring that anyone you authorize to use your account on your behalf (employees, contractors, assistants) also complies with these Terms.
Bessie is offered on a monthly subscription basis. By subscribing, you authorize us to charge your payment method on a recurring monthly basis for the plan you select, plus any applicable taxes and usage-based fees disclosed at signup.
You may cancel your subscription at any time from your account settings or by contacting us at [[email protected]]. Cancellation takes effect at the end of your current monthly billing period — you will retain access to the Service through the remainder of the period you've already paid for, and you will not be charged again going forward.
We do not provide refunds or credits for partial months, whether cancellation occurs early in the billing cycle or otherwise.
You agree not to use Bessie to:
You are solely responsible for obtaining proper consent from your own customers before Bessie contacts them by text, email, or phone on your behalf, and for complying with all laws applicable to your business and industry.
Bessie is built using underlying technology infrastructure provided by third-party platforms. In order to deliver the Service, your business information and customer data may be processed by these infrastructure providers and other third-party services (such as payment processors and messaging carriers) necessary to operate features like bookings, payments, and communications.
You retain ownership of your business data and your customer data. We will not sell your customer data. For details on how data is collected, used, and protected, see our Privacy Policy.
You are responsible for the accuracy of the data you input into Bessie and for maintaining any consents required to lawfully use that data.
The Bessie name, logo, design, and all related branding are the property of [Legal Business Name]. Your content — your business information, customer data, and materials you upload — remains yours. By using the Service, you grant us a limited license to use that content solely to operate and provide the Service to you.
We aim to keep Bessie available and reliable, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or issues with underlying third-party infrastructure outside our control. We are not liable for losses resulting from such interruptions.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED, OR THAT IT WILL MEET YOUR SPECIFIC BUSINESS OUTCOMES.
TO THE FULLEST EXTENT PERMITTED BY LAW, [LEGAL BUSINESS NAME] AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless [Legal Business Name] from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party right, including any claims related to messages Bessie sends to your customers on your behalf.
We may suspend or terminate your access to the Service if you violate these Terms, fail to pay applicable fees, or engage in conduct that we reasonably believe harms the Service, other users, or third parties. Upon termination, your right to use the Service ends immediately, though certain provisions of these Terms (including Sections 6, 9, 10, and 11) survive termination.
We may update these Terms from time to time. If we make material changes, we will provide notice (such as by email or an in-app notice) before the changes take effect. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Maryland, without regard to its conflict of laws principles. Any dispute arising from these Terms or your use of the Service will be resolved in the state or federal courts located in Maryland, and you consent to the personal jurisdiction of those courts.
Questions about these Terms can be sent to [[email protected]] or [mailing address].
